Justice Bello Kawu, wey deliver the ruling on Tuesday, order say Malami make dem release am under the same bail conditions wey EFCC earlier consider, pending when court go hear the main motion on notice.

According to the court order, Malami must submit im international passport and perfect bail bonds wey two sureties go sign for am.

The two sureties na:

  • Director-General of the Nigerian Legal Aid Council, and

  • One serving member of the House of Representatives wey dey represent Augie/Argungu Federal Constituency.

The matter dey before the court as Motion No: M/17220/2025, between EFCC as applicant and Abubakar Malami (SAN) with Temitope Isaac Adebayo as respondents.

While granting the application, Justice Kawu say the court don carefully look the motion ex-parte, the 22-paragraph affidavit wey Muhsin Malami swear to, and the written address wey dem file according to court rules.

Lawyer to the applicant, M. E. Sheriff, Esq., beg the court make e use discretion to grant the bail, citing exceptional hardship.

The judge also order make the earlier bail conditions wey Malami fulfill on November 28, 2025 remain valid and active. These conditions include submission of passport and provision of the two sureties.

After the ruling, the court adjourn the case to January 5, 2026, for hearing of the motion on notice before the High Court of the Federal Capital Territory, Court No. 2, wey Justice Sylvanus Chinedu Oriji dey preside over.

Malami, wey serve as Attorney-General throughout the eight years administration of former President Muhammadu Buhari, dey under EFCC probe over allegations linked to im time for office. Justice Kawu, while reading the ruling, confirm say the application for bail don get court approval, and the matter go continue on January 5, 2026.
