The detained IPOB leader, Mazi Nnamdi Kanu, don file new motion for Federal High Court Abuja wey him take beg the judge make dem throway all the charges wey Federal Government carry put for him head and release am sharp sharp.

The motion, wey Kanu file by himself on October 30, 2025, get title “Motion on Notice and Written Address in Support.”For inside, him talk say the charges no get any legal ground because dem base on old laws wey don expire.

According to Kanu, the government dey use repealed laws like the Customs and Excise Management Act (CEMA) and the old Terrorism Prevention (Amendment) Act 2013 wey don already waka commot since the new Nigeria Customs Service Act 2023 and TPPA 2022 replace dem.

He yarn say this kain wahala no fit stand for court because Section 36(12) of Nigeria Constitution no allow anybody make dem charge person for offence wey no dey law again.

Kanu also remind the court say Supreme Court don already talk for FRN v. Kanu (SC/CR/1361/2022) say any law wey don expire, lower courts must take notice. If dem no do am, e go make all the court matter null and void.

He come add say the alleged offence wey dem talk say he commit happen for Kenya, and under Section 76(1)(d)(iii) of TPPA 2022, any such case must first get validation from Kenyan court before Nigeria fit try am. Him say this one don break the African Charter on Human and Peoples’ Rights.

Kanu say anything wey no follow Constitution na waste of time, and he quote cases like Aoko v. Fagbemi (1961) and FRN v. Ifegwu (2003) where conviction based on dead law don already cancel before.

He beg the judge make dem order government lawyer to reply within three days and make the court give ruling before November 4, 2025. Kanu talk say him motion na pure legal and constitutional matter, so e no need affidavit.
